Recently purchased this 2009 FX35 AWD knowing about this and it really didnt bother me as the car is in pristine condition and purchased for $10,800. This car was Canadian. How come DMV never caught this? Is it their responsibility to flag these and request an update on the car?

The DMV just does reporting only I believe. It's the responsibility of the owner/consumer to check the report like which you did with a carfax.
